Operating in Georgia in 2026 requires management of the April 1st registration deadline and the new 4.99% flat tax regime. States Business Consulting ensures your Peach State entity remains compliant from Atlanta and Savannah to Augusta.

I. Peach State Entity & Tax Setup

STEP 01

eCorp Registration (SOS)

Formalize your LLC ($100) or Corporation ($100) via the Georgia Secretary of State's eCorp portal. Georgia allows multi-year registration filings (up to 3 years) for streamlined future compliance.

STEP 02

Georgia Tax Center (DOR)

Register for Sales Tax (4% state base) and Withholding. Note that for 2026, the 4.99% flat rate must be applied to all corporate and individual income tax projections.

STEP 03

Local Occupational Tax

Georgia does not have a "general" state business license; instead, most cities and counties (like Fulton or DeKalb) require an Occupational Tax Certificate (Business License) based on gross receipts or employee count.

II. 2026 Compliance & Legal Shifts

April 1st Annual Registration

Reports are due between January 1 and April 1. The 2026 fee is $60 (including the $10 service fee). Missing this window results in a $25 late fee and administrative dissolution risk.

III. Workforce & Employer Systems

Employer standards are managed by the Georgia Department of Labor (GDOL):

Unemployment Tax (GDOL)

Employers must register for a DOL Account Number. For 2026, the taxable wage base remains $9,500. Quarterly tax and wage reports are mandatory for all active employers.

Workers' Comp (SBWC)

Mandatory for all businesses with 3 or more employees (regularly in service, part-time or full-time). This threshold is lower than many neighboring states.
